Terms of Service

1. Acceptance of Terms
By accessing or using CloutPost AI ("Service," "we," "us," or "our") at cloutpost.cc, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.
2. Description of Service
CloutPost AI is an AI-powered social media content generation tool. The Service allows registered users to generate written content for platforms including LinkedIn, X/Twitter, Instagram, Facebook, Threads, and TikTok using Anthropic's Claude AI model. Users may optionally connect their LinkedIn account to publish content directly.
3. Account Registration
You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. We reserve the right to suspend or terminate accounts at our discretion.
4. Payment Terms
4.1 Free Plan
Free accounts are limited to five (5) AI generations per day. No payment is required.
4.2 Clout Basic (Credits)
Clout Basic is a one-time credit purchase of $4.99 USD for 50 generation credits. Credits do not expire and roll over indefinitely. Additional credit packs may be purchased at any time. Credits are non-refundable once purchased and consumed.
4.3 Clout Pro (Subscription)
Clout Pro is a monthly subscription at $9.99 USD per month, granting up to 500 AI generations per calendar month. Subscriptions renew automatically at the end of each billing period. You may cancel at any time; access continues until the end of the paid period. Unused monthly generations do not roll over.
4.4 Refund Policy
All purchases are final. We do not offer refunds for unused credits, partial subscription months, or unused generations, except where required by applicable law. If you believe you were charged in error, contact us at Deathadder90@protonmail.com within 7 days of the charge.
4.5 Payment Processing
All payments are processed by Stripe, Inc. We do not store your full payment card details. By making a purchase, you agree to Stripe's Terms of Service.
5. Acceptable Use Policy
You agree not to use the Service to generate or publish content that:
- Is illegal, defamatory, harassing, threatening, or abusive
- Infringes on the intellectual property rights of any third party
- Contains spam, misleading information, or deceptive advertising
- Violates the terms of service of any social media platform you publish to
- Promotes hate speech, discrimination, or violence
- Is sexually explicit or obscene
We reserve the right to suspend or terminate your account for any violation of this policy, without refund.
6. Intellectual Property
6.1 Your Content
You own the content generated through the Service. By using CloutPost AI, you are granted a license to the generated output for any personal or commercial purpose. We make no claim of ownership over content you generate.
6.2 Our Platform
The Service, including its interface, brand, code, and trademarks, are owned by CloutPost AI. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
7. AI-Generated Content Disclaimer
Content generated by the Service is produced by an AI model (Anthropic Claude) and is provided "as is." We make no representations or warranties regarding the accuracy, originality, fitness, or legality of AI-generated content for any particular purpose. You are solely responsible for reviewing, editing, and verifying content before publishing it. AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. We are not liable for any consequences arising from publishing AI-generated content.
8. Third-Party Services
The Service integrates with third-party platforms including Anthropic (AI generation), Stripe (payments), Supabase (data storage and authentication), and LinkedIn (optional direct publishing). Your use of these integrations is also subject to those third parties' terms of service. We are not responsible for the availability, security, or actions of third-party services.
9. LinkedIn Integration
By connecting your LinkedIn account, you authorize CloutPost AI to publish posts on your behalf using the permissions you grant via LinkedIn's OAuth flow. You may revoke this access at any time from your LinkedIn account settings or from your CloutPost AI dashboard. You remain solely responsible for all content published to your LinkedIn account through the Service and must comply with LinkedIn's User Agreement.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLOUTPOST AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless CloutPost AI and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or content you publish using the Service.
13. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases. Paid credits and subscriptions will not be refunded upon termination for cause. Provisions that by their nature should survive termination will survive, including Sections 6, 10, 11, and 12.
14. Changes to Terms
We may update these Terms at any time. If we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or class action.
